ACCOMMODATION 
AGREEMENTA

Scope of application
Article 1
1. Contracts for Accommodation and related agreements to be concluded between this Hotel and the Guest to be accommodated shall be subject to the provisions of these Terms and Conditions, and any particulars not provided for herein shall be governed by laws and regulations and/or generally accepted practices.
2. In the event that the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the provisions of the preceding Paragraph, the special contract shall take precedence over the provisions of the preceding Paragraph.

Application for accommodation contract
Article 2
1. A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
⑴Name of guest
⑵Date of stay and expected arrival time
(3) Accommodation fees (in principle, based on the accommodation fees in Appendix 1)
(4) Other particulars deemed necessary by the Hotel
2. In the event that the Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph (2) of the preceding Paragraph, the Hotel shall treat such request as if he/she had made an application for a new Accommodation Contract at the time such request was made.

Establishment of accommodation contracts, etc.
Article 3
⑴ An Accommodation Contract shall be deemed to have been concluded when the Hotel accepts the application stipulated in the preceding Article. However, this shall not apply if the Hotel proves that it did not accept the application.
⑵ When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, limited to the basic accommodation fee for the period of stay (if it exceeds three days, for three days), shall be paid by the date specified by the Hotel.
(3) The application fee shall first be applied to the accommodation fee to be paid by the guest in the end, and in the event of a situation to which the provisions of Articles 6 and 17 apply, it shall be applied to the penalty and then to compensation, in that order, and the remainder, if any, shall be refunded at the time of payment of the fee pursuant to the provisions of Article 12.
⑷ If the application fee stipulated in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same Paragraph, the Accommodation Contract shall become invalid, provided that the Hotel has so notified the Guest when specifying the due date for payment of the application fee.

Special agreement waiving the application fee [Special agreement waiving the application fee]
Article 4
⑴ Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract pursuant to which the application fee stipulated in the same Paragraph shall not be required after the Contract has been concluded.
⑵ If, when accepting an application for an Accommodation Contract, the Hotel does not request payment of the application fee as set forth in Paragraph 2 of the preceding Article or does not specify a date for payment of the application fee, the application shall be treated as having been accepted as having accepted the special contract set forth in the preceding Paragraph.

Refusal to conclude an accommodation contract
Article 5
1. The Hotel may refuse to enter into an Accommodation Contract in any of the following cases:
⑴ When the application for accommodation does not comply with these terms and conditions.
⑵ When the hotel is fully booked and there are no rooms available.
(3) When it is deemed that the person seeking accommodation is likely to engage in conduct that violates the provisions of laws and regulations, public order or good morals in relation to his/her accommodation.
⑷ When the person seeking accommodation is a member of an organized crime group, a member of an organized crime group, an organization or person related to an organized crime group, or other anti-social forces.
(5) When the person seeking accommodation is a member of an organized crime group or a corporation or other organization whose business activities are controlled by an organized crime group member.
(6) When the person seeking accommodation is a corporation and one of its officers is a member of an organized crime group.
(7) When the person seeking accommodation makes violent demands against the Hotel or the Hotel staff, or makes demands that are beyond the reasonable scope of the circumstances.
(8) When the person seeking accommodation is clearly recognized as carrying an infectious disease.
9. When accommodation is not possible due to natural disasters, facility malfunctions, or other unavoidable reasons.
10. When the person seeking accommodation is likely to cause inconvenience to other guests due to drunkenness, etc. When the person's behavior is such that it is a significant nuisance to other guests.

Guest's right to cancel accommodation contract
Article 6
1. The Guest may cancel the Accommodation Contract by notifying the Hotel.
2. In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the event that the Hotel has specified a due date for payment of the application fee pursuant to the provisions of Article 3, Paragraph 2 and requested payment, and the Guest cancels the Accommodation Contract prior to such payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has accepted a special contract as set forth in Article 4, Paragraph 1, this shall apply only if the Hotel has notified the Guest of the obligation to pay a penalty in the event that the Guest cancels the Accommodation Contract, in accepting such special contract.
3. If the Guest does not arrive by 8:00 p.m. on the day of accommodation without contacting the Hotel (or by two hours after the expected arrival time if the Guest has specified such time in advance), the Hotel may consider the Accommodation Contract to have been cancelled by the Guest.

Hotel's right to cancel contract
Article 7
1. The Hotel may cancel the Accommodation Contract in any of the following cases:
⑴ When the guest is deemed to be liable to engage in conduct that violates the provisions of laws and regulations, public order or good morals in relation to his/her stay, or when the guest is deemed to have engaged in such conduct.
⑵ When the guest is clearly recognized as carrying an infectious disease.
(3) When accommodation is not possible due to force majeure such as a natural disaster.
⑷ When the person is a member of an organized crime group, a member of an organized crime group, an organization or person related to an organized crime group, or any other anti-social force.
(5) When the person is a corporation or other organization whose business activities are controlled by an organized crime group or a member of an organized crime group.
(6) When a corporation has an officer who is a member of an organized crime group.
(7) When the Guest makes violent demands against the Hotel or the Hotel staff, or demands an unreasonable burden.
8) When the case falls under Article 5 of the Okinawa Prefecture Hotel and Inn Business Law Enforcement Ordinance.
9. When a guest is likely to cause inconvenience to other guests due to drunkenness, etc. When a guest's speech or behavior is extremely disruptive to other guests.
10. When the Guest smokes in the guest room, tampers with fire-fighting equipment, or fails to comply with any of the prohibited actions set forth in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention purposes).
2. When the Hotel has cancelled the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Hotel shall not charge the Guest any fees for any accommodation services, etc. that he/she has not yet received.

Accommodation registration
Article 8
1. The Guest will be required to register the following particulars at the front desk of the Hotel on the day of accommodation:
(1) Name, age, sex, address and occupation of the guest
(2) For foreigners, nationality, passport number, place of entry and date of entry
⑶ Departure date and scheduled departure time
(4) Other particulars deemed necessary by the Hotel
2. If the Guest intends to pay the charges stipulated in Article 12 by any means other than Japanese currency, such as traveller's cheques, accommodation vouchers or credit card, these shall be presented in advance at the time of registration stipulated in the preceding paragraph.

Room occupancy time
Article 9
1. Guests may use the guest rooms of this Hotel from 3:00 PM to 12:00 PM the following day. However, if a separate time is specified in the accommodation plan, etc., that time shall take precedence. In addition, in the case of consecutive stays, guests may use the guest rooms all day, except on the days of arrival and departure.
2. Notwithstanding the provisions of the preceding paragraph, the Hotel may permit the Guest to occupy the room outside of the hours specified in the same paragraph. In such cases, an additional fee will be charged as set forth in the Usage Regulations established by the Hotel.
3. If the Guest intends to pay the charges stipulated in Article 12 by any means other than Japanese currency, such as traveller's cheques, accommodation vouchers or credit card, these shall be presented in advance at the time of registration stipulated in the preceding paragraph.

Compliance with the rules of use
Article 10
1. Guests shall abide by the Hotel Usage Regulations established by the Hotel and posted within the Hotel.

Opening hours
Article 11
1. Detailed opening hours of our hotel facilities will be displayed on the television screen in your guest room.
2. The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.

Payment of fees
Article 12
1. The breakdown and calculation method of the Accommodation Charges, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
2. Payment of the accommodation fees, etc. set forth in the preceding paragraph shall be made by currency or by any other means acceptable to the Hotel, such as travellers' cheques, accommodation vouchers or credit cards, at the front cashier upon the Guest's arrival or upon request by the Hotel.
3. Accommodation charges shall be charged even if the Guest voluntarily does not utilize the accommodation facility after it has been provided and made available for use by the Hotel.
4. The Hotel may request a deposit upon arrival of the Guest to guarantee payment of incidental expenses (telephone charges, food and beverage charges, and other miscellaneous expenses) in addition to the accommodation fee. The deposit will be settled upon departure.

Liability of the Hotel
Article 13
1. The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or non-fulfillment of the Accommodation Contract and/or related agreements, unless such damages are due to reasons not attributable to the Hotel.
2. The Hotel is covered by corporate liability insurance to deal with the unlikely event of a fire or other disaster.

Handling when contracted rooms cannot be provided
Article 14
1. When the Hotel is unable to provide a contracted room to a Guest, it will arrange accommodation of the same standards elsewhere for the Guest, with the Guest's consent, wherever possible.
2. Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange other accommodation for the Guest, the Hotel shall pay the Guest a compensation fee equivalent to the penalty charges, which shall be applied to the amount of damages. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay a compensation fee.

Handling of deposited items, etc.
Article 15
1. The Hotel shall compensate the Guest for damages when loss, breakage or other damage occurs to goods, cash or valuables deposited at the Front Desk by the Guest, except in cases where this has occurred due to causes of force majeure.
2. The Hotel shall compensate for any damages incurred by the Guest due to loss, breakage, or other damage caused intentionally or negligently by the Hotel to any goods, cash, or valuables brought into the Hotel by the Guest but not deposited at the Front Desk. However, for any items for which the Guest has not previously reported the type and value, the Hotel shall compensate for such damages up to a maximum of 150,000 yen.

Storage of the Guest's baggage or belongings
Article 16
1. When the baggage of the Guest is brought into the Hotel prior to his/her arrival, the Hotel shall be liable to store it only in the case where the Hotel has agreed in advance to such arrival and shall hand it over to the Guest at the Front Desk at the time of his/her check-in.
2. If a guest leaves behind cash or valuables (※) at the hotel after checking out, the hotel will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner cannot be identified, the hotel will store the items for seven days, including the day they are found, and then turn them over to the nearest police station. Other items will be disposed of after two months. However, food, drinks, tobacco, magazines, etc. will be disposed of the day after check-out.
*1 "Cash and valuables" refers to items with a certain value, such as wallets (cash), credit cards, cameras, mobile phones, watches, precious metals, prepaid cards, etc., as well as items that may be misused by third parties, such as driver's licenses and insurance cards.
3. The Hotel’s liability regarding the custody of the Guest’s baggage and belongings in the cases of the preceding two Paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of Paragraph 2.

Parking Responsibility
Article 17
1. When a Guest uses the Hotel's parking lot, regardless of whether the Guest has deposited the vehicle key with the Hotel, the Hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the Hotel causes damage through intentional or negligent acts on the part of the Hotel in managing the parking lot, the Hotel shall be liable for compensation.

Guest Responsibilities
Article 18
1. If the Hotel suffers damage due to intentional or negligent acts on the part of the Guest, the Guest shall compensate the Hotel for such damage.

Disclaimer
Article 19
1. Guests shall use computer communications from within the Hotel at their own risk. The Company shall not be liable for any damages suffered by users as a result of service interruptions due to system failures or other reasons while using computer communications. Furthermore, if damages are caused to the Company or third parties due to actions that the Company deems inappropriate in the use of computer communications, the guest shall be required to compensate for such damages.

Personal Information Protection
Article 20
1. Personal information disclosed by guests in connection with the accommodation contract will be managed in accordance with the Act on the Protection of Personal Information.

Preferred language
Article 21
1. These Terms and Conditions are written in both Japanese and English. In the event of any inconsistency or discrepancy between the two versions, the Japanese version shall prevail.
